In 1991, the U.S. Congress passed the Omnibus Transportation Employee Testing Act when they recognized the need for a drug and alcohol-free transportation industry. The act required DOT agencies to implement drug and alcohol testing of safety-sensitive employees to maintain the safety of the traveling public and workers.
The DOT’s drug screening rules and procedures are listed within Title 49 of the Code of Federal Regulations (CFR) Part 40, commonly known as “Part 40.” These rules are published by an office within the DOT: the Office of Drug & Alcohol Policy & Compliance (ODAPC).
Anyone designated in DOT regulations as a “safety-sensitive” employee is subject to DOT drug and alcohol testing. A safety-sensitive employee is someone who holds a job that can impact both their own safety and the safety of the public.

Today, urine remains the most commonly used drug specimen because of its familiarity, its cost to test, and its detection of a wide range of drugs for inclusion on test panels.

A breath-alcohol test is the most common test for finding out how much alcohol is currently in the blood.
The person blows into a breath-alcohol device and the results are quantitative. Breath alcohol results quantify the Breath Alcohol Concentration (BrAC). It shows the concentration of alcohol in the breath at the time of taking the test.
BrAC levels correlate with impairment, and the legal limit of 0.08 for driving has been set in all states. Under DOT regulations, a BrAC of 0.02 is high enough to stop someone from performing a job. They can be stood down for a specific amount of time (usually between 8 and 24 hours).
A BrAC reading of 0.04 or higher is a positive alcohol test under DOT regulations. A positive test requires immediate removal from safety-sensitive functions.
Under DOT regulations, a person who tests at the 0.04 BrAC level may not resume job duties. In order for them to perform safety-sensitive duties, they must complete the return-to-duty process.
Hair testing can be useful in settings where drug testing is scheduled (such as pre-employment and return-to-duty screenings), because of its long detection window.
An individual with substance abuse issues may choose to abstain from drug use for a few days when facing a scheduled oral fluid or urine drug test in order to subvert the detection of drugs in their body.
It can be far more difficult for habitual drug users to refrain from drug use for 90 days in order to pass a hair test.

Oral fluid drug tests are collected by the donor while under supervised observation which makes tampering with the test sample virtually impossible.
Oral fluid is a good specimen type for remote work locations and organizations who have physical contact with their candidates and employees (i.e. offices, manufacturing plants, distribution centers, etc.).
The narrow but immediate detection window makes it a natural choice for reasonable suspicion testing and for post-accident testing.
Oral Swab drug testing also has a proven track record for better detection of heroin as opposed to urine drug testing.
